1. Acceptance of Terms

By downloading, installing, accessing, or using the Acnera mobile application ("App," "Service," or "Acnera"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional terms and policies referenced herein. If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Acnera ("Company," "we," "us," or "our").

2. Eligibility

2.1 Age Requirement

You must be at least 13 years of age to use Acnera. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

We do not knowingly collect personal information from children under 13. If we discover that a child under 13 has provided us with personal information, we will promptly delete it. If you believe a child under 13 has used the App, please contact us at support@acnera.app.

2.2 Capacity

By using the App, you represent and warrant that:

You have the legal capacity to enter into a binding contract.
You are not barred from receiving services under the laws of any applicable jurisdiction.
You will comply with these Terms and all applicable local, state, national, and international laws.

3. Description of Service

Acnera is an AI-powered skincare and acne management application that provides:

AI Skin Analysis: Camera-based analysis of acne type, skin score, redness, and pore visibility using machine learning models.
Ingredient Scanner: OCR-powered scanning of skincare product labels to identify ingredients, safety ratings, and compatibility conflicts.
Progress Photo Tracking: Dated photo logs with comparison tools to visualize skin changes over time.
Habit & Routine Tracker: Logging of skincare routines, water intake, sleep, menstrual cycle, stress levels, and journal entries.
Personalized Insights: AI-generated correlations between habits, product use, and skin health patterns.
Gamification Features: Daily quests, achievements, and mini-games designed to encourage consistent skincare habits.

4. Health and Medical Disclaimer

4.1 Not Medical Advice

THE APP DOES NOT PROVIDE MEDICAL ADVICE. All content, analysis, recommendations, insights, and information provided by Acnera — including AI-generated skin analyses — are for informational and educational purposes only and do not constitute:

Medical diagnosis
Medical treatment
Prescription or recommendation of any medication or medical procedure
A substitute for professional medical advice

4.2 Consult a Professional

Always seek the advice of a qualified dermatologist, physician, or other licensed healthcare provider with any questions you may have regarding acne, skin conditions, or any other medical condition. Never disregard professional medical advice or delay seeking it based on information provided by the App.

4.3 AI Limitation

AI skin analysis results are generated by machine learning models and may be inaccurate, incomplete, or misleading. Factors including lighting conditions, camera quality, image angle, and skin tone variation can affect results. You should not rely solely on AI analysis for skincare decisions.

4.4 Product Ingredients

Ingredient safety ratings and compatibility assessments provided by the App are based on publicly available databases and general research and do not account for individual allergies, sensitivities, or medical conditions. Always conduct a patch test before using new skincare products and consult a healthcare professional if you have sensitive skin or known allergies.

5. Acnera Pro Subscription

5.1 Subscription Requirement

Access to the full functionality of Acnera requires an active Acnera Pro subscription. Without an active subscription, access to features is limited.

5.2 Auto-Renewal

Acnera Pro is an auto-renewable subscription purchased through Apple In-App Purchase. Your subscription will automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.

5.3 Billing and Payment

Payment will be charged to your Apple ID account at confirmation of purchase.
Your account will be charged for renewal within 24 hours prior to the end of the current billing period.
Subscription prices are subject to change. We will provide reasonable notice of any pricing changes.
You can manage and cancel your subscription at any time through your device's Settings > [Your Name] > Subscriptions.

5.4 Free Trials

If a free trial is offered, it begins upon subscription and converts to a paid subscription at the end of the trial period unless cancelled before the trial ends. Only one free trial per Apple ID may be offered.

5.5 Restore Purchases

If you reinstall the App or use a new device, you can restore your prior purchases using the "Restore Purchases" option within the App.

5.6 Refunds

All refund requests for Apple In-App Purchases must be directed to Apple. We do not process refunds directly. To request a refund, visit reportaproblem.apple.com or contact Apple Support.

5.7 Apple EULA

Purchases made through the App are also governed by Apple's End User License Agreement. In the event of a conflict between Apple's EULA and these Terms, Apple's EULA will prevail with respect to the purchase.

6. User Accounts

6.1 Account Creation

The App may initially create an anonymous account for you using Supabase authentication. You may optionally link your account to an email address and password, or sign in using Sign in with Apple.

6.2 Account Security

You are responsible for:

Maintaining the confidentiality of your account credentials.
All activities that occur under your account.
Notifying us immediately of any unauthorized access at support@acnera.app.

6.3 Account Termination by You

You may delete your account at any time from within the App (Profile → Delete Account). Account deletion is permanent and irreversible. Upon deletion:

All personal data stored on our servers will be permanently deleted.
Photos and images stored in our cloud storage will be permanently removed.
Your subscription, if active, will not be automatically cancelled — you must cancel separately through Apple's subscription management.

6.4 Account Termination by Us

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that violates these Terms, is harmful to other users, or for any other reason we deem appropriate.

7. User Content

7.1 Your Content

"User Content" includes all photos, images, journal entries, product data, and other information you submit, upload, or store within the App ("User Content").

7.2 Ownership

You retain full ownership of your User Content. By uploading content to the App, you grant Acnera a limited, non-exclusive, royalty-free, worldwide license to store, process, display, and transmit your User Content solely for the purpose of providing the App's services to you. This license terminates when you delete the content or your account.

7.3 Prohibited Content

You agree not to upload, store, or transmit any User Content that:

Contains nudity or sexually explicit material.
Depicts violence, self-harm, or harmful activities.
Violates the privacy or intellectual property rights of any third party.
Contains malware, viruses, or other malicious code.
Is fraudulent, misleading, or constitutes harassment.

7.4 No Sale of User Content

We will never sell your User Content or photos to third parties for advertising or commercial purposes unrelated to providing you the App's functionality.

8. Intellectual Property

8.1 Our Property

The App, including its design, code, text, graphics, logos, AI models, and all associated intellectual property, is owned by Acnera and protected by copyright, trademark, and other applicable laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works from the App without our prior written consent.

8.2 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us a perpetual, irrevocable, royalty-free license to use, implement, and commercialize such feedback without obligation to you.

9. Prohibited Uses

You agree not to:

Use the App for any unlawful purpose.
Attempt to gain unauthorized access to any part of the App or its backend systems.
Reverse-engineer, decompile, or disassemble the App.
Use automated tools (bots, scrapers, crawlers) to access the App.
Upload content containing personal data of third parties without their consent.
Use the App to diagnose, treat, or manage a medical condition for others.
Impersonate any person or entity.
Interfere with the security or proper functioning of the App.
Circumvent subscription requirements through technical means.

10. Third-Party Services

The App integrates with the following third-party services, each governed by their own terms:

We are not responsible for the practices, content, or availability of third-party services. Your use of third-party services is governed solely by their respective terms.

11. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or completeness of AI-generated analysis
Uninterrupted or error-free operation

We do not warrant that the App will meet your requirements or that any results obtained from the App will be accurate or reliable.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACNERA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages.
Loss of profits, data, or goodwill.
Damages arising from reliance on AI-generated skin analysis.
Damages arising from any skincare decisions made based on App recommendations.
Damages arising from unauthorized access to your account.
Any damages exceeding the amount you paid for the App in the twelve (12) months preceding the claim.

Some jurisdictions do not allow limitation of liability for personal injury or certain other damages, so the above limitation may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Acnera and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the App.
Your User Content.
Your violation of these Terms.
Your violation of any applicable law or regulation.
Your violation of any third-party rights.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the App shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (AAA), except that either party may bring claims in small claims court.

14.3 Class Action Waiver

YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION against Acnera.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

Updating the "Last Updated" date at the top of this page.
Sending a notification within the App.
Providing notice via the email address associated with your account (if applicable).

Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

16. Apple-Specific Terms

As required by Apple's App Store Review Guidelines, the following provisions apply:

These Terms are between you and Acnera, not Apple, Inc. ("Apple").
Apple has no obligation to provide maintenance or support for the App.
Apple is not responsible for any product liability claims related to the App.
In the event of any third-party claim that the App infringes intellectual property rights, Acnera (not Apple) is responsible for investigation and defense.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
Your use of the App must comply with the Apple App Store Terms of Service.

17. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Acnera regarding the App.
Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
Waiver: Failure to enforce any right or provision does not constitute a waiver.
Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
